7. Possible changes by the company
While CLOSER PERU will use its best endeavors to operate all tours as advertised, by entering into this contract the Client accepts that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions. CLOSER PERU reserves the right at any time to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes.
If a major change is known to us, the Client will be told at the time of the booking. If a major change becomes necessary after booking CLOSER PERU will inform the Clients as soon as reasonably possible. When a major change is made the Client will have the choice of accepting the change of arrangements, purchasing any other available tour or canceling the tour and obtaining a full refund. Provided that the major change is not because of force majeure.
Force majeure is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of CLOSER PERU. CLOSER PERU is not liable for any charges in the event of a change -beyond their control- to the departure time or date of a tour, flight or other form of transport.
Accidents en route may require trip interruption; CLOSER PERU strongly recommends the purchase of comprehensive travel insurance (accident, baggage, trip interruption, etc.) which can be obtained through either CLOSER PERU or your travel agent. Unexpected and unforeseen local conditions beyond the control of CLOSER PERU may force the company to alter or curtail the itinerary of the tour in order to secure the passengers' safety, health and enjoyment.
CLOSER PERU reserves the right to increase the tour cost to take account of the following items: due to unfavorable changes in exchange rates, increases in air fares or other transportation/ fuel costs, increases in local operator costs, taxes, or if government action should require us to do so. If the surcharge results in an increase of more than 10% of the tour cost, the Client may cancel the booking within 7 days notification of the surcharge and obtain a full refund (payments for flights, cruises and Inka Trail bookings are non-refundable due to airlines and operators´ policies). No surcharge will be imposed within 30 days of departure.
Cancellation request must be received in writing.
All passengers must be in possession of a passport valid at least six months after the tour commencement. As each country's visa requirements vary for US or non-US citizens, we recommend that you consult with the respective country's embassy and / or consulate. It is the sole responsibility of the passengers to obtain the proper documentation and visas independently.
All Clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their choosing. Persons over 60 years of age will be advised to obtain medical evidence of fitness to travel on the chosen itinerary.
Some special programs such as Inka trail may have stringent health requirements. Please check with your personal physician to verify your particular needs. You are strongly recommended to purchase a travel insurance to protect you for the unexpected. CLOSER PERU is not responsible for any costs incurred as a result of medical services or for the quality of medical care received.
Vaccinations are usually not mandatory to enter Peru. However we remind you that traveling in Peru does require certain precautions. It is therefore highly recommended that you check with your personal physician to verify your particular needs. Most travelers take Hepatitis A&B and Tetanus. Some shots need to be taken well in advance. CLOSER PERU is not in the position to tell you to do or not to do any vaccinations. Please check with your family doctor for details.
Persons with medical conditions or problems including special diets, allergies, illness or disability or undergoing treatment for any physical or medical condition, etc should make them known to CLOSERPERU well before arrival. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the tour in which case all monies paid will be forfeit.
We reserve the right to disqualify anyone at any time during the tour if it is felt that the individual is physically incapable of performing an activity and/or if that individual’s continued participation would jeopardize the safety of the group or handicap the normal functioning of scheduling of the tour. CLOSER PERU assumes no responsibility for special arrangements necessary or problems experienced for or by passengers physically unable to participate in the planned activities
As a condition of booking, it is the Client’s responsibility to take out travel insurance and to make sure they have adequate cover.
Travel insurance is mandatory for all Clients whilst on a tour organized by CLOSER PERU. Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance. A suitable insurance policy should provide adequate cover for medical expenses arising through illness or accident prior to or during the holiday and loss of holiday monies through cancellation or curtailment of the holiday for insurable reasons. Clients should ensure that there are no exclusion clauses limiting protection for the type of activities in their tour. Clients should satisfy themselves that any travel insurance arranged is what they require and should arrange supplementary insurance if need be. Travel insurance is able to protect you against any losses due to any changes that may occur prior to your travels, as well as providing security for the duration of your travels.
13. General Reservation Information
Please provide us with the following reservation information in order to process your reservation: each passenger’s first and last name, passport numbers, date of birth, any other Special Requests or requirements (special diets, allergies, medical conditions, disabilities, etc).We may request additional information as deemed necessary and/or required to handle and complete the reservation.
CLOSER PERU will use its best endeavors to ensure that all flight prices are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on an airfare, it guarantees that a booking is being held for you, it DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the flight booking has been paid for in full and a ticket has been issued. Flight bookings cannot be transferred.
The flight times given by CLOSER PERU are for general guidance only and are subject to change. Up-to-date flight times will be shown on the tickets. The Client must check the tickets very carefully immediately upon receipt of the latest timings. CLOSER PERU will endeavor to inform the Client as soon as possible in the event of any flight alteration. Details of airlines are also subject to change. Such alterations do not constitute a significant change to the holiday arrangements and will therefore not be entitled to cancel without paying the normal charges as a result.
Flight times are provided by airlines and are subject to air traffic control measures. All methods of transportation are subject to weather conditions and the need for constant maintenance, and the ability of passengers to check in on time. While the vast majority of methods of transportation do depart on time, delays can occur and there is no guarantee that flights, ferries, ships, trains or coaches will depart at the time stated by the Company to the Client or on the ticket sent to the Client. The timings are estimates only and the Company does not have any liability to you for any delay which may arise. Where such delays arise the Company will not be liable for additional refreshments or appropriate meals, although in the cases of international flights the carrier, where possible, may provide refreshments and take further appropriate action. We suggest you check your travel insurance for possible cover for these events.
CLOSER PERU can not be held responsible for any delay to your flight whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the rescheduling of flight times by the airline, mechanical breakdown, strike, industrial action or any other reason.
CLOSER PERU cannot guarantee the accuracy of any hotel, resort or other leaflet which is not published by them but may be supplied as an additional service to the Client.
CLOSER PERU accepts responsibility for ensuring that the holiday which the Client books with them is supplied as described in the final version of the travel program the Client will receive upon arrival and the services reach a reasonable standard.
CLOSER PERU acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, it is not responsible for injury, sickness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through willful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the tour, or through natural disasters, social upheavals or other causes.
We reserve the right to decline to accept, or to retain, any person as a tour member for any reason that affects the operation of the tour or the rights and welfare or enjoyment of the tour members. The abuse of any alcoholic drink or consumption of any illegal drug during the trip is strictly prohibited.
Prostitution or any compensation of sexual favors is prohibited in any tour or hotel facilities provided by COSER PERU. In addition, any client involved in this type of activities will be disqualified at any time during the trip. CLOSER PERU assumes no responsibility for special arrangements necessary for or by passengers due to his/her behavior.
CLOSER PERU condemns all forms of sexual exploitation of children and supports all acts of law made to prevent and punish such crimes. For this reason, we will cancel the contract with any person or company that in any ways, contribute, facilitate, tolerate or promote the commercial sexual exploitation of children and adolescents.
All participants in tours operated by CLOSER PERU are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve CLOSER PERU of all obligations that they may otherwise have under these booking conditions.
17. If the Client has a Complaint
In the unlikely event that the client has complaints about the accommodation or any other service provided by the Company, this should be reported to the tour leader or other representative of CLOSER PERU at the time so that they may use their best endeavors to rectify the situation. If the Client has a complaint about any of the tour arrangements he/she must bring it to the attention of the tour leader or other representative of CLOSER PERU at the time so that they may use their best endeavors to rectify the situation. It is only if CLOSER PERU is made aware of any problems that there will be the opportunity to put things right. Complaining to CLOSER PERU as a problem arises during your trip will allow us to remedy the situation or facilitate compensation. Should the problem remain unsolved, a complaint must be made in writing to CLOSER PERU within 29 days of the completion of the holiday. The Company will not consider any claims outside this period.
We will provide your personal information, as well as any personal information you provide in relation to the persons whose travel arrangements have been requested by you, to suppliers and carriers to enable the operation of the services requested by you.
